These Terms of Service ("Terms") govern your access to and use of Outdoors website, mobile applications for iOS and Android, APIs, and related services (collectively, the "Service"), operated by Outdoors ("Outdoors," "we," "us," or "our").
By creating an account, downloading our iOS or Android app, or using any part of the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Scope and Acceptance
These Terms apply to all users, including visitors, registered members, contributors, and any organization using the Service through its employees or agents.
- You represent that you can form a binding contract under applicable law.
- If you use the Service for an organization, you represent you can bind that organization.
- Additional terms may apply to specific features (for example, beta programs).
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have permission from your parent or legal guardian. You are responsible for complying with local age requirements in your jurisdiction.
3. Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Protect your login credentials and device access
- Notify us promptly of unauthorized access or suspected compromise
- Remain responsible for activity under your account unless caused by our breach
We may suspend, limit, or terminate accounts that violate these Terms, create security risk, or appear fraudulent.
4. User Content
The Service may allow you to submit reviews, ratings, photos, route notes, conditions updates, comments, and other materials ("User Content").
- You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, adapt, publish, and distribute that content to operate and improve the Service.
- You represent you have all rights and permissions needed for your User Content, including from individuals depicted in photos where required.
- You agree not to upload unlawful, infringing, confidential, or safety-compromising content.
Content that you delete may persist for backups, abuse prevention, legal compliance, and cached copies for a limited period.
5. Community and Conduct Rules
When using our Service, you agree NOT to:
- Post false, misleading, dangerous, or manipulated safety information
- Harass, threaten, dox, exploit, or otherwise harm others
- Upload malware, abuse APIs, or probe or bypass security measures
- Scrape or harvest data at scale without our written authorization
- Impersonate individuals, agencies, rangers, rescue teams, or entities
- Use the Service for unlawful conduct or rights violations
- Interfere with Service reliability or attempt to degrade platform performance
6. Intellectual Property
Except for User Content, the Service and all related software, design, data compilations, trademarks, and branding are owned by Outdoors or its licensors and are protected by intellectual property laws.
You receive a limited, revocable, non-transferable, non-exclusive license to use the Service for personal, non-commercial use, subject to these Terms.
7. Third-Party Platforms and App Stores
The iOS app may be distributed through Apple App Store and the Android app may be distributed through Google Play or other authorized stores. Your use of those stores is also governed by each store's terms.
- Apple and Google are not responsible for the Service or its support and maintenance.
- Any refund, subscription management, billing disputes, and cancellation mechanics may be controlled by the applicable store.
- You must comply with export and sanctions laws and represent you are not restricted from receiving software under those laws.
8. Outdoor Safety and No Emergency Use
The Service is for informational purposes only and is not emergency-response software. Do not rely on the Service as your sole safety system.
- Conditions, closures, weather, hazards, and access rules can change rapidly.
- Always confirm critical details with official agencies and local authorities.
- In emergencies, call local emergency services immediately.
- Offline maps and saved content may be stale, incomplete, or inaccurate.
9. Data Sources and Mapping Content
The Service may include geospatial data from government agencies, open datasets, commercial providers, and user contributions. We strive for quality but cannot guarantee completeness, timeliness, legal access status, or field accuracy for every location.
You are solely responsible for route decisions, permit compliance, weather planning, equipment, and physical readiness.
10. Purchases, Subscriptions, and Billing
Some features may require paid plans. If you purchase through a web checkout or app store, you authorize the applicable payment processor or store to charge applicable fees and taxes.
- Subscriptions may auto-renew unless canceled before renewal.
- Price changes take effect after notice and as permitted by law.
- Promotions can include additional terms and may be withdrawn.
- Where required by law, refunds are available under applicable consumer rights.
11. Beta Features
We may offer experimental features marked as beta, preview, or early access. Beta features may be incomplete, unstable, and changed or removed without notice.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE.
We do not warrant that defects will be corrected, data will be current in real time, or that the Service will satisfy your specific outdoor safety requirements.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OUTDOORS APP AND ITS OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING FROM OR RELATED TO THE SERVICE.
To the maximum extent permitted by law, our aggregate liability for all claims related to the Service will not exceed the greater of (a) USD $100 or (b) the amount you paid us for the Service during the 12 months before the event giving rise to liability.
14. Assumption of Risk and Release
Outdoor activities involve inherent risks, including severe weather, terrain hazards, wildlife, water conditions, altitude effects, road and trail closures, and equipment failure. By using the Service, you knowingly assume these risks.
To the fullest extent permitted by law, you release Outdoors from claims arising from injuries, losses, or damages connected to your outdoor activities planned or informed by the Service.
15. Indemnification
You agree to indemnify, defend, and hold harmless Outdoors and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the Service, or infringement of rights.
16. Termination and Suspension
We may suspend or terminate access at any time for security, abuse prevention, legal compliance, or material breach of these Terms.
- You may stop using the Service at any time.
- If your account is terminated, provisions that by nature should survive will survive, including intellectual property, disclaimers, liability limits, and dispute terms.
17. Communications and Notices
You consent to receive electronic communications from us, including transactional notices, product updates, and legal notices, by email, in-app messaging, or posting in the Service.
18. Changes to the Service and Terms
We may update, change, suspend, or discontinue all or part of the Service at any time. We may update these Terms periodically, and material changes will be posted with an updated effective date. Your continued use after the effective date constitutes acceptance of revised Terms.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles, except where consumer law in your jurisdiction provides mandatory protections that cannot be waived.
Before filing formal claims, both parties agree to attempt good-faith informal resolution by written notice. If unresolved, disputes will be resolved by binding arbitration administered by the American Arbitration Association, unless prohibited by applicable law. Either party may seek relief in small claims court where eligible.
Class actions and representative proceedings are waived to the fullest extent permitted by law. If this waiver is unenforceable in your jurisdiction, it will apply only to the extent allowed by law.
20. Export Controls and Sanctions
You may not use or export the Service in violation of U.S. export laws, sanctions programs, or other applicable trade restrictions. You represent you are not located in, or ordinarily resident of, a restricted jurisdiction where use is prohibited.
21. Severability and Waiver
If any provision is held invalid or unenforceable, the remaining provisions remain in full force. A failure to enforce any provision is not a waiver of future enforcement.
22. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
23. Entire Agreement
These Terms, our Privacy Policy, and any referenced supplemental terms form the entire agreement between you and Outdoors regarding the Service and supersede prior agreements on the same subject.
